These Terms of Service ("Terms") govern your access to and use of pontis.co and any related services (the "Services"), operated by Pontis ("Pontis", "we", "us", or "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

Eligibility

You must be at least the age of majority in your jurisdiction, or have the consent of a parent or guardian, to use the Services or place an order.

Products, pricing & availability

We strive to describe and display products accurately, but we do not warrant that product descriptions, images, colors, or other content are error-free. Prices and availability are subject to change without notice. We reserve the right to limit quantities, correct errors, and refuse or cancel any order.

Orders & acceptance

Your submission of an order is an offer to purchase. All orders are subject to acceptance by us, and we may decline or cancel an order at our discretion, including where we suspect fraud or an error in pricing or availability. Where we cancel an order you have paid for, we will issue a refund.

Custom & private label programs

Custom and private label products are produced to order based on specifications approved by you. Additional terms — including timelines, minimums, approvals, and payment — are set out in the applicable project agreement, which governs those orders in the event of any conflict with these Terms.

Intellectual property

The Site and its content — including the Pontis name, logo, text, graphics, and designs — are owned by Pontis or our licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute our content or marks without our prior written permission.

Acceptable use

You agree not to use the Services for any unlawful purpose, to infringe our or others' rights, to interfere with or disrupt the Services, or to attempt to gain unauthorized access to any part of the Services.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, except as required by applicable law. We do not warrant that the Services will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, Pontis will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Pontis and its officers, employees, and agents from any claims, liabilities, damages, and expenses arising out of your breach of these Terms or your misuse of the Services.

Governing law

These Terms are governed by the laws of the State of Hawaii, United States, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Hawaii for any dispute arising out of these Terms or the Services.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date, and your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
